Essential Tips for Completing and Sending the Templates
Updated: Dec 12, 2020
There are a number of "rules" I strongly advise people to stick to when going through the process of challenging these alleged debts.
These guidelines are generally common sense tips for organising yourself. They come from experience of helping literally thousands of people successfully wipe alleged debts. Ignore at your own peril.
7 GOLDEN RULES
1. Do not email them, Do not text them, do not phone them. Send paper copies. If you have no printer, try a local library or college. Or even handwrite them. Make sure you do them word for word, letter for letter though. They have been precisely written with Legalese in mind.
2. Keep a copy of each notice you send to a particular company
3. Send to a CEO/ Director at their registered address - Not a PO Box
4. Sign in blue ink to help negate the possibility of a fraudulent debt collector "lifting" your signature and preparing false documents
5. Send the letters through recorded delivery. Keep the tracking receipts in a safe place along with the other related material and mark each one with the account number it represents
6. Use the royal mail tracking site to print out the signature of the person who received and signed for the notices. Attach them to the tracking receipts and copies.
7. Keep a record of all their attempts to phone text email or turn up on your doorstep. It doesn't matter whether you answered/ responded to them or not. What is important is to collate evidence of their harassment after you have sent them the Cease & Desist Notice (included within the templates I have written).
Before I continue I want to point out it is imperative that you watch my video primer on the conditional acceptance process. Go watch it - its in the Videos Section
I will now give you tips on how to fill out.
Some of this will be painfully obvious to some people, but for people entirely new to this its easy to become overwhelmed. So I am going to start with an easy one: Your Name.
>NAME
In the templates you will notice that there are a number of instances where you must enter in your name. There are two distinct methods, both are necessary. It is not the aim of the article to explain why right now, as it will distract from the goal of this being a concise, no-nonsense guide. So... You will see this:
[Name-Secondname], of the family: [Surname]
An example of how it is to be filled out is like so:
Aileen-Mary, of the family: Reilly
And if you see this:
[YOUR NAME IN CAPS] or "CAPS LEGAL NAME" (in the Estoppel)
Then it is simply meant to be filled as this:
AILEEN REILLY
Or whatever the name to which the demands are being made against. Most likely yours!
>CEO & ADDRESS
As stated earlier, it is important that you send to a director, preferably the CEO and very important that you send to the registered address of the company and not a PO Box.
Must demands you receive will have the registered address in the footer information found at the bottom of their letter. In the event of those that dont then you will need to look up that information. There are many websites where you can obtain this information as well as the director list etc. Obviously their website is a good place to start but it is not always made clear. Good resources for finding information include websites such as CompanyCheck and Endole Now in the case for Statute Barred Debt Notice (Tax Credits), for different departments you can find the relevant address from HM Revenue and Customs (government website link)
>DATES
So this is pretty straight forward stuff. In the template Notices there are a number of instances in each template where it says the following
[Date in Full]
There you simply enter the date relative to the context of the sentence. So if its the date you are writing a letter, put that date. If it is the date on one of their letters, put that date. If it is like this:
[Date In Full] (received [Date In Full])
Then it would be either the date they have on their letter and the date you received it OR the date you wrote a letter and the date they received it.
Remember: You can ascertain when they received a letter from using the tracking number on the receipt you got when you sent it recorded delivery. You obtain that information - complete with their signature - from the Royal Mail website.
>AMOUNTS
Hopefully this is self-explanatory.
[Amount in Full]
Then you edit in the amount they claim you owe.
>COMPANY / DEPARTMENT NAME
There are many instances throughout the templates where you fill see the following:
“Debt Collection Agency” (or any of its affiliated agents, parent companies, proxies, etc)
Wherever you see "Debt Collection Agency", then you edit in... you guessed it.. the name of the DCA which is pursuing you.
Similarly, if you are using the Statute Barred Notice (Tax Credits), then replace the form of alleged debt with the relevant department
>SIGNING OFF & WITNESSES
You will remember I wrote earlier for you to use blue ink when you sign. This is to help lessen the possibility that the debt collection agency (DCA) will attempt to steal your signature and use it to prepare documents as to fraudulent present proof of your liability to the alleged debt.
Yes, this has happened before.
Signing in blue ink will making it more difficult to spot forgeries. So use blue. There is also the argument of the symbolic use of the colours, but that is another conversation.
There are also a couple of other safety measures to take. So it is prudent to do the following:
1. Sign in blue ink
2. Allow your signature to overlap some of the printed text
3. Include the date as part of the signature
I have shown an example image from the estoppel. Just try to imagine that's wet-signed with blue ink and not purple-coloured scrawl done in MS Paint. Notice there are witness signatures. These are somewhat optional but stem from the practise of traditionally having an estoppel notarised by a Scrivener. Although it is "relatively" cheap to do, it is not always possible for people. So in lieu of this, you can have two friends, or independent peoples (who do not share your family name) witness them instead. IF there is anything you feel I have missed from this guide, please comment and I will endeavour to edit in any forgotten additions post haste. Thank you and good luck!
